Youth jailed for phone robbery

KOTA KINABALU: A 21-year-old youth was sentenced to 15 months’ jail for robbery by the Sessions Court here yesterday.

Mohd Afiq Masrani admitted to snatching a Samsung Galaxy S4 phone from 22-year-old Saniah Md Budin before judge Ainul Shahrin Mohamad on July 11 this year in front of Wisma Budaya.

The charge framed under Section 390(2) of the Penal Code, is punishable under Section 392 of the same Code with a maximum jail term of 14 years, whipping and a fine, if found guilty.

The facts of the case stated that a police report was lodged by the victim on July 11 at 3.48 pm, stating that her Samsung S4 had been snatched by an unknown man in front of Wisma Budaya while she was walking in the direction of Asia City. In her report, she claimed to have screamed for help, and asking members of the public to help her, which eventually led to the arrest of the accused and the return of her (victim) phone.

The unrepresented Mohd Afiq, in mitigation, requested for a lighter sentence from the court.

Deputy public prosecutor Nartiah F Mirchelle Sambatan, pressed the court for a deterrent sentence as the offence committed by Mohd Afiq was serious and rampant.
