Native chief faces up to 80 years’ jail on five counts of sexual offences

KOTA KINABALU: A 37-year-old native chief is facing up to 80 years’ imprisonment on five counts of sexual offences.

However, the accused claimed trial to all five charges which were read to him before three separate judges. On the first charge, before sessions court judge Azreena Aziz, the accused pleaded not guilty to committing carnal intercourse against the order of nature with his 10-year-old nephew at a village in Kota Belud in October, this year at around 7pm.

The offence is framed under Section 377C of the Penal Code and punishable with a prison term not exceeding 20 years, as well as whipping. He also pleaded not guilty to inciting the same victim to an act of gross indecency at the same place, time and date.

Azreena granted the unrepresented accused bail of RM20,000, with RM10,000 deposited under two local sureties, before fixing Dec 8 for case management.

Framed under Section 377E of the Penal Code, the offence is punishable with a maximum prison term of five years and whipping.

The accused was then brought before judge Dean Wayne Dally, where he pleaded not guilty to two similiar charges, when he committed the alleged offence on his 14-year-old nephew.

Dean allowed the accused bail of RM20,000, with RM10,000 deposited under two local sureties, totalling his bail to RM40,000.

His case management date was also fixed by Dean on Dec 8.

He also claimed trial before judge Ainul Shahrin Mohamad for attempting to rape his 11-year-old sister at the same place in the month of October between 6pm and 7pm.

Framed under Section 376/511 of the Penal Code the offence is punishable with a maximum jail term of 30 years as well and not less than 10 strokes of the cane.

Ainul did not offer the accused bail, but fixed his case management on Dec 12.
