Murder accused to know fate on Dec 17

SIBU: Businessman Jacob Tiang who is facing murder charges and a charge for attempted murder will know his fate on Dec 17 when the High Court here passes its judgment.

Judge Supang Lian fixed the date yesterday after hearing the clarification of submissions by both the prosecution and the defence.

Jacob was ordered to enter his defence on Nov 18 when the court ruled that the prosecution had made a prima facie case against him on three charges of murder and a charge of attempted murder.

He was accused of killing his wife Ling Yung Ming, teenage daughter Christine Tiang Soon Ai and toddler son Victor Tiang Soon Seng and an attempted murder of his son Vincent Tiang on July 5 last year at their house in Pulau Li Hua.

The three murder charges under Section 302 of the Penal Code carry the mandatory death sentence upon conviction.

The charge for attempted murder was filed under Section 307 of the Penal Code.

In his submission, defence counsel Ben Lau said there was a possibility of involvement of a third party in the killing of the deceased or at the least the possibility of Ling Yung Ming killing Christine and Victor could not be eliminated during the absence of the accused from 7.20am to 7.50am from the scene of incident.

He pointed out that the motive for Ling to kill Christine and Victor could have been found in the five wills written by Ling.

He further said Vincent had testified that Ling was furious and angry with him when Ling knew that he (Vincent) did not go to school on July 3, 2013.

However, on July 5, it was Ling herself who asked Vincent to continue sleeping though it was a school day, when Vincent woke up for the second time.

It was also Ling who gave Vincent the two blue pills on the night of July 4, 2013.

He thus submitted that Ling might be the mastermind who plotted the killing of the whole family.

Deputy Public Prosecutor Mohd Azrul Faidz Abdul Razak told the court in his submission that the testimony by defence witness Su Ming Ngiik was nothing but revealed the truthfulness of the sequel of events that occurred on July 5.

First he said on July 5 when Vincent woke up at around 6.20am, Jacob had asked Vincent not to go to school and asked him to continue sleeping.

Vincent then went back to sleep and after that, he heard hissing sound like gas coming out and smelt something strange.

Then Vincent woke up and asked Ling about it, but Ling said it was nothing and asked Vincent to go back to sleep.

He also said Su in her statement estimated the time that that Jacob went to buy the two gas tanks at her shop to be around 7.30am.

He submitted that it was when Vincent was sleeping that Jacob went to buy the two gas tanks from Su.

He also said there was no involvement of another party except Jacob himself.

He further said Vincent was a credible witness.
