Dec 12 set to deliver ruling on sodomy, threatening charges

KOTA KINABALU: The Sessions Court here will rule on December 12 whether the prosecution had established a case against a man for two counts of sodomising and threatening a boy.

Judge Indra Hj Ayub set the date to deliver his ruling on Ismail Hassan, 36, after the prosecution closed its case two days ago.

On the first count, the accused was alleged to have committed carnal intercourse against the order of nature on the boy aged eight at a house in a village in Inanam at 2pm on August 7, 2013.

He was charged under Section 377C of the Penal Code which provides for a maximum jail of 20 years and whipping, upon conviction.

The second charge accused Ismail of threatening the boy at the same time and place.

The offence, under Section 506 of the Penal Code, provides for a jail term of up to seven years and also liable to a fine, upon conviction.

Deputy public prosecutor Aida Fatimah Datuk Abdul Jabbar had called six witnesses to testify against the accused since the trial commenced on Nov 10, 2013.
