Foreigner faces death penalty on two counts of murder

KOTA KINABALU: A 29-year-old foreigner is facing the death penalty on two counts of murder.

However, Kimhal Nujul pleaded not guilty to both charges when produced before High Court Judge Stephen Choong.

On the first charge, Kimhal was alleged to have killed Chan Ching Woei, 43, on November 8 this year inside a room of the Wang Lai (KK) Marine Food office building along Jalan Bundusan in the district of Penampang between 12 and 6:40am.

Next, he purportedly murdered Chan Ching’s wife, 45-year-old Chang Ling Ling, at the same place, time and date.

Both offences are framed under Section 302 of the Penal Code, and is punishable by hanging.

Kimhal, a fish-packer who works at the company, was defended by counsel Datu Baginda Datu Laja, though he was not present during the proceedings.

Deputy public prosecutor Afzan Abd Kahar asked for a case management date as well as a trial date, adding that she needed to get clarification from Datu Baginda as to whether he would be defending Kimhal.

Stephen ordered that both parties go for a pre-trial conference by January 23, next year before fixing the case management on February 2, 2015 and the trial on June 15 – 19, 2015.
