Mechanic charged with hitting neighbour

KOTA KINABALU: A 42-year-old mechanic was charged in the Magistrate’s Court here yesterday for hitting his neighbour.

Ng Kin Hin pleaded guilty before magistrate Mohd Fahiz Omar to the offence he committed at Kampung Kitobu, Jalan Kiansom Inanam at 5pm on Dec 13.

He hit his neighbour, Hiew Jing Kui, 57, which is an offence under Section 323 of the Penal Code and is punishable with a prison term not exceeding one year, a fine of RM2,000, or both.

Though he pleaded guilty, no sentence was meted out as prosecuting officer Inspector Syahrin Ali had yet to receive a medical report from the victim, prompting him to ask for a sentencing date. Syahrin also proposed bail of RM6,000 with two local sureties, but Ng Kin declined to say anything about the bail. His sentencing was fixed on Jan 16, next year and was allowed bail of RM3,000 with two local sureties.

Ng Kin was also given a condition that he made no contact with the victim, or his bail would be forfeited.

Meanwhile, in a separate case, a 28-year-old foreigner was charged with molesting a woman. Ajilan Sadalamil, claimed trial to the offence before Fahiz which he committed on November 18 in Sinsuran at around 4:45pm.

The offence, under Section 354 of the Penal Code, carries a maximum jail term of 10 years, a fine and whipping upon conviction. Syahrin requested a case management bail and informed the court that as Ajilan was also facing trial for illegally entering the country, no bail was offered.

The court then fixed January 3 for the case management. The same court then sentenced a 24-year-old man to nine months’ jail for possessing a fake MyKad. Abdul Hadi Aini pleaded guilty before the same magistrate to the offence which he committed on Dec 8, in Sinsuran, at around 4:45pm.

The MyKad had the name of one Abdul Hadi Ainin and bore numbers 900412-12-6317. Possessing a fake MyKad is an offence under Regulation 25(1)(e) of the National Registration Regulation, and carries a maximum fine of RM20,000 or a prison term not exceeding three years.

He was also ordered to be referred to the Immigration Department for further action once he completed his prison sentence.
