Drug trafficking case goes to High Court

KUCHING: The Magistrates’ Court here yesterday transferred a drug trafficking case to the High Court here for a plea and trial hearing.

Magistrate Zulhairil Sulaiman allowed the application made by DPP Fadzila Ishak to transfer the case involving Eva Sylviana and Wahyudin, both in their 40s, for allegedly trafficking methamphetamine.

The accused persons are facing the mandatory death penalty if convicted under Section 39B(1)(a) of the Dangerous Drugs Act, 1952.

No plea was recorded from both accused persons.

Eva was arrested at the Kuching International Airport on Oct 5 last year where a total of 6.61 kg of methamphetamine was found on her while Wahyudin was picked up from a hotel along Jalan Tun Jugah along with 3.13kg of methamphetamine on Oct 6.

It was reported that the drug was found hidden inside a few pairs of platform heels placed inside a compartment of Eva’s luggage.

Initial investigation showed that they flew from Hong Kong on separate flights and transited in Kuala Lumpur before arriving here.

They were ordered to be further held in custody under Section 259 of the Criminal Procedure Code pending disposal of the case as the alleged offence is a non-bailable one.

In a separate case, a man who was placed under supervision for consuming drugs landed himself a year in jail
as well as given one whipping after he breached the court order.

Raziman Hazami, 28, from Kampung Tanjung Bundong in Kota Samarahan, committed the offence at 8am on Feb 16 at the district National Anti Drug Agency office here.

A urine test conducted on him by anti-drug agency officers he tested positive for amphetamine and methamphetamine.

The magistrate convicted him under Section 6(2)(d) of the Dangerous Drugs Act, 1952 for breaching the court order imposed on him under Section 38B of the same code.
