Sentencing of Pakistani duo with fake passes deferred

KOTA KINABALU: The Sessions Court here yesterday deferred the sentencing of two Pakistani men, charged with using forged travel documents, to April 22 this year.

Judge Dato’ Ishak Bakri deferred the sentencing of Shamsul Alam Habib Rasool, 30, and 25-year-old Afzal Khan Mirasan Khan, at the request of the prosecution.

Malaysian Anti-Corruption Commission (MACC) prosecuting officer Michael Joimin made the request for deferment of the sentencing for both accused on the grounds that there was a criminal revision filed at the High Court here.

Michael said the revision was filed against the two Pakistani men, who had been convicted on February 26 this year for committing a similar offence.

The two accused had changed their pleas of not guilty to one of guilty under Section 471 of the Penal Code, punishable under Section 465 of the same Code, when their case came up for management.

The indictment carries a jail term of up to three years and a fine, upon conviction.

Shamsul Alam was alleged to have used his Social Visit Pass which contained false information claiming that he was married to one Manisah Sabal, aged 28. The alleged offence was committed at the Kepayan Detention Centre on October 14.

Meanwhile, Afzal Khan was accused of using a forged Multiple Entry Visa, in which it claimed that he was married to one Sharwaty Samporang, 22. He allegedly committed the offence at the Papar Temporary Detention Center on February 4.

Both accused were denied bail and are currently detained under Section 259 of the Criminal Procedure Code, pending disposal of their cases.
