Two men charged with drug trafficking

KOTA KINABALU: Two men were charged at the Magistrate’s Court here yesterday for trafficking 395 grams of cannabis.

No plea was taken from Mohd Zaim Zuhaffar, 21, and Muhammad Sirhan Abdul Rashid, 28, when they were brought before magistrate Mohd Faiz Omar.

They were charged with trafficking the drugs at the University Apartment in Menggatal on March 5, this year at around 4:45pm.

The offence, framed under Section 39B of the Dangerous Drugs Act 1952, is punishable with the mandatory death penalty. The court fixed April 29 for case management.

Meanwhile, the duo also faced additional drug charges.

On the first count, Mohd Zam, was also charged with possessing 3.0 grams of cannabis at the same place, time and date.

The offence, under Section 6 of the same Act, carries a maximum fine of RM20,000, or a prison term no longer than five years, or both.

Next, he was charged with possessing 1.30 grams of methamphetamine, at the same place, time and date. The offence is punishable with a fine not more than RM100,000, or five years prison term as stated in Section 12 of the same Act.

Thirdly, he was charged with consuming ecstasy pills, along with methamphetamine and amphetamines at the same time, place and date.

It is an offence under Section 15 of the same Act, and carries a fine of RM5,000, or a prison term of two years, upon conviction.

The court fixed April 29 for his case management.

Muhammad Sirhan on the other hand was charged with possessing 6.0 grams of cannabis and consuming methamphetamine. The court set April 22 and 29 for the next hearing.

Counsel Haji Ansari, who acted for Mohd Zaim, informed the court that a letter would be written, so that his client, who was suffering from Scoliosis, had been harassed by the police.

Meanwhile Muhammad Sirhan’s lawyer, counsel PJ Perera, stated that he would apply to lodge a report on the issue of the police abuse.

In response, prosecuting officer Inspector Jakariyah Jupakkal, stated that it was up to the doctor to determine if both accused had been injured by the police, adding that the prosecution was not objecting to the accused being taken to the hospital.
