Court upholds sentence on former school bus driver for reckless driving

KUALA LUMPUR: A former school bus driver yesterday failed in his attempt to set aside his conviction and two-year jail sentence imposed on him by the Traffic Court for reckless driving that caused the death of a soldier and his seven-month pregnant wife three years ago.

High Court Judge Kamardin Hashim, in dismissing the appeal by Samad Din, 67, against the conviction and sentence, said there was no merit in the appeal.

He concurrent with the two-year jail sentence handed down by the Traffic Court and that it was safe to uphold the conviction.

Samad was sentenced to two years’ jail and fined RM6,000 by the Traffic Court on Sept 5 last year after he was found guilty of reckless driving to an extent of causing the death of Corporal Mohd Hafeeze Mohd Hanapi, 30, and Siti Nooredayu Roslan, 26, at Jalan Keramat here at 7am on Aug 1, 2012.

Samad’s driving licence was also suspended for three years. He paid the fine.

According to the facts of the case, the school bus which Samad was driving at the time of the accident, had been sent for inspection at Puspakom two months earlier, but following an investigation, it was found that the Puspakom certificate for the vehicle was not renewed due to a faulty brake system.

The accident occurred while Mohd Hafeeze was sending his wife, who was seven-months pregnant, to work on his motorcycle before going to his office at the Defence Ministry.

The prosecution was represented by deputy public prosecutor Raihanah Abd Razak, while lawyer Mohd Yusoff Ag. Lah represented Samad. — Bernama
