Man denies robbing Korean

KOTA KINABALU: A man, charged with committing armed robbery on a Korean national, has pleaded not guilty at the Sessions Court here yesterday.

Ferjar Joni denied the charge when he appeared before Sessions Court judge Ainul Mohamad Shahrin.

Ferjar was charged with robbing a Korean national, Yoon Chan Soo, of RM30 cash and a smartphone, all of which were worth RM1,500, at the public beach in Tanjung Lipat, Likas on May 9, last year at around 5.30 am, while armed with an eight inch knife.

The offence, framed under Section 395/397 of the Penal Code, is punishable with a prison term of up to 20 years and whipping, upon conviction.

The court set April 8 for case management and ordered for him to be remanded under Section 259 of the Penal Code, pending disposal of the case.

Meanwhile, at the High Court, an appeal in a rape case was ordered to be remitted back to the lower court.

Chief Judge of Sabah and Sarawak, Tan Sri Richard Malanjum, made the order in the rape case of the appellant, who was convicted and sentenced on two counts of rape of both his cousins by the lower court.

The appellant, represented by counsel Joan Goh, had appealed against the sentence and conviction handed down by the lower court on the second count on the basis that the second victim was 16 years old, hence there was no question of force being exerted on the victim.

The judge made the order for the appeal on the first count to be dismissed, while the conviction and sentence in respect of the second count be set aside. On the first offence, the court ruled that the accused could appeal before another judge.

On the first charge, the accused was sentenced to 12 years jail and two strokes of the cane, while on the second charge, he was sentences to 13 years jail and to be given three strokes of the cane.
