Man jailed for stealing golf balls from resort

KOTA KINABALU: A foreigner was jailed 50 days for breaking into a resort and stealing golf balls.

Magistrate Mohamad Faiz Omar made the order on Ahmad Arab, 32, after the latter pleaded guilty to the offence which he committed on March 19 at around 11.20pm.

He trespassed into the poolside area of the Sutera Harbor Resort Hotel and stole golf balls.

The offence, under Section 447 of the Penal Code, is punishable with a prison term not exceeding three months, a fine of RM1,000, or both.

He was also ordered to be referred to the Immigration Department for further action.

Prosecuting officer Inspector Jakariyah Jupakkal prosecuted.

In another court, another foreigner was charged with possessing another person’s MyKad.

Benazir Abdullah, 28 pleaded not guilty before magistrate Cindy Mc Juce Balitus to committing the offence along Jalan Sepanggar on March 25 at 6am.

He was in possession of a MyKad bearing number 820807-12-5685. The offence, under Rule 25(1)(o) of the National Registration Regulations, is punishable with a maximum fine of RM20,000, or a prison term not exceeding three years.

The court fixed April 30 for his case management and ordered him to be remanded as he did not possess proper documentation.

In a separate case, the High Court issued a warrant of arrest against a local who was convicted and sentenced for selling various contraband cigarettes.

Chief Judge of Sabah and Sarawak Tan Sri Richard Malanjum made the order on 24-year-old Radjfikal Ladja, who was represented by counsel Dato Sri Rakhbir Singh.

Rakhbir wanted to withdraw the appeal as his client had not shown up for the proceedings.

Radjfikal was sentenced to six months’ imprisonment and fined RM587.20, in default, three months’ imprisonment for smuggling contraband cigarettes.

The accused was detained at Baran and Brothers Tradings grocery store at Taman Sepanggar along Jalan Sepanggar on November 11, last year at 11am.

He was detained with 214 packets of contraband cigarettes of various brands amounting to RM29.36.

The offence, under Section 135(1)(d) of the Customs Act 1967, carries a fine not less than 10 times the amount of customs duty, or RM50,000 or a prison term not exceeding three years, or both, upon conviction.

Prosecuting officer Mohd Izhanudin Alias from the Customs Department in Kuala Lumpur prosecuted the case.
