May 13 for hearing judicial review against Sabah Immigration director and three others

KOTA KINABALU: The High Court here yesterday set May 13 this year for the full hearing of a judicial review filed by a peninsula-based solicitor against the Director of Immigration Sabah and three others for the refusal to allow her to enter Sabah.

Justice Stephen Chung fixed the hearing date for the judicial review of Ambiga Sreenevasan, 59, who was represented by counsel James Tsai when the case came up for mention.

According to Tsai, all the respondents had served their reply submissions to Ambiga’s affidavit and court had given time for Ambiga to give her reply submission to all the respondents.

Ambiga had filed her ex-parte application naming Director of Immigration Sabah Noor Alam Khan A Wahid Khan, Ghulam Jelani Khanizaman (in his capacity as State Authority under Section 62 of the Immigration Act 1959/63), Chief Minister of Sabah (as State Authority under Section 62 of the Immigration Act 1959/63 and/or as Minister responsible for Immigration) and Moktar Yassin Ajam (in his capacity as the Secretary of the Internal Affairs and Research (Setiausaha Hal Ehwal dalam Negeri & Penyilidikan) as the first, second, third and fourth respondents respectively.

In his judicial review application, Ambiga (the applicant) sought for an Order of Certiorari to quash the Notice of Refusal of Entry dated 14.11.2014 issued by the first respondent who refused the applicant entry into Sabah.

She also sought for an Order of Mandamus to compel the first, second, third and/or fourth respondents to allow the applicant entry into Sabah.

Apart from that, she also sought damages, costs and further and other relief which the court deems fit and proper.

Senior federal counsel Mohd Rahazlan Affendi acted for the first respondent while the other respondents were represented by counsel Hanafiah Kassim.
