Court adjourns ruling in causing grievous hurt case

KUCHING: A Sessions Court here yesterday adjourned to May 12 for a ruling involving voluntarily causing grievous hurt to two students.

Judge Amelati Parnell fixed the date at the end of prosecution case against three persons namely Ramshah Ramlan, 24, Mohd Sumarulnizam Ademan, 24, and Mohamad Fadilah Ramli, 35.

They face two charges under Section 326 of the Penal Code read with Section 34, which carries of up to 20 years’ imprisonment, a fine and/or whipping.

They allegedly assaulted two students namely Nicholas Gandik Ningkan and Casspetra Bawok Aldrin using a machete inside the guard post at Jalan Muara Tabuan here around 6.30pm on April 6 last year.

The incident was caught on CCTV and had gone viral on social media.

The court also ordered them to be further remanded in jail pending the completion of the case.

The accused initially pleaded guilty to the offence but were released on court bail to spend Hari Raya celebration.

When the Chief Justice of Sabah and Sarawak Tan Sri Panglima Richard Malanjum learnt of the case he called for the judgment to be expedited.

The accused however failed to turn up for the case and after being summoned and a warrant of arrest were issued the police looked for them until they were all collared.

They changed their plea during the second mention but the court denied them bail.

DPP Stella Augustine Druce prosecuted while the accused persons were defended by Lim Lian Kee and Azam Trudin.
