Judge dismisses appeal against inadequacy of sentence imposed

KUCHING: The High Court here dismissed an appeal by the prosecution against the inadequacy of sentence imposed on a man convicted of a robbery charge.

Judge Alwi Abdul Wahap yesterday affirmed the eight years’ jail and five lashes meted on Amy Syaifullah Agong Ajis, 26, by a Sessions Court judge.

The sentence was imposed in March after he pleaded guilty to robbing a teenage girl of her handbag containing two smartphones, a few hundred ringgit cash and her MyKad.

He had also caused hurt to her, the offence committed at Kampung Tabuan Melayu here around 1.30am on Feb 13 this year.

After the victim lodged a report, he was arrested by police on Feb 26 and convicted under Section 392 of the Penal Code.

In another case, a group of men were released on six months’ bond of good behaviour in the sum of RM2,000 each after they admitted to having threatened and assaulted a man at Stampin Baru, Jalan Stutong Baru here last week.

The accused persons, aged between 16 and 41, committed the offence at 11pm on April 24.

It was learnt that nine men known to the man came to his house and they had an argument. The victim was punched.

It was learnt that the incident was caused by a misunderstanding.

The victim’s sister lodged a police report.

All the accused were detained on April 27.
