Man denies molesting niece

KOTA KINABALU: The Magistrate’s Court here yesterday set June 23 this year for the trial of a man for allegedly molesting his niece.

Magistrate Cindy Mc Juce Balitus set the date for the case of 50-year-old accused after he pleaded not guilty to a charge under Section 354 of the Penal Code.

The indictment provides for a jail term of up to 10 years or with a fine and with whipping, upon conviction.

The accused was accused of using criminal force to outrage the modesty of his 15-year-old niece in a car parked by the roadside near a zoo in Lok Kawi at noon on May 13.

The magistrate released the accused on RM7,000 bail with two local sureties, pending disposal of the case.

In another Magistrate’s Court, a local man, who worked at a carwash, will be tried on June 19 this year for a charge of committing mischief on a person’s property.

Albert Sebin, 29, who appeared before magistrate Stephanie Sherron Abbie, was charged under Section 435 of the Penal Code for damaging RM50 worth of property by setting it on fire at a village in Menggatal at 2.50pm on April 24.

The charge carries a jail term of up to seven years and also liable to a fine, upon conviction.

The accused was granted RM3,500 bail with two local sureties.

Prosecuting officer Inspectors Azaman Hamat and Lim Swee Beng appeared for the prosecution.
