Foreigners convicted for committing obscene act on mountain

KOTA KINABALU: Four youths, who were among a group of 10 foreigners that had accepted a challenge to strip naked on the peak of Mount Kinabalu, were each jailed for three days and fined RM5,000, in default, three months’ jail by the Sessions Court here today.

Judge Dean Wayne Daly imposed the sentence on Eleanor Grace Hawkins, 22, Lindsey Peterson, 23, Dylan Thomas Snel, 23 and Daniella Anne Louisa Peterson, 22 after they pleaded guilty to their separate charges of committing an obscene act within the vicinity of the mountain peak in Ranau at 6.45am on May 30.

They were convicted under Section 294(a) of the Penal Code which carries a maximum jail of three months or a fine or both, upon conviction.

The court ordered Hawkins of England, Peterson siblings from Canada and Snel, who hails from Netherland, to serve their jail terms of the date of their arrests on June 9.

In his decision, the judge held that by pleading guilty to the charges, the accused had saved court and prosecution’s time and they are all first offenders.
