Company fined for possessing unregistered skin products

KOTA KINABALU: A company was fined RM1,000, in default, one month’s jail by the Sessions Court here yesterday for possessing unregistered skin products.

Merchant Creation Sdn Bhd’s representative, who is a director of the company, pleaded guilty before judge Indra Ayub to a charge under Rule 7 (1)(a) of the Control Drugs and Cosmetic Regulations 1984 and punishable under Section 12 (2) of the Sales of Drug Act 1952.

The indictment provides for a maximum fine of RM50,000 and for a second or subsequent offences, shall also liable to a maximum fine of RM100,000, upon conviction.

The company had possessed unregistered products of 19 boxes of Borneo Crocodile Oil Cream, 21 bottles of Crocodile Oil (Multi-purpose Skin Healer Oil) and a bottle of Nutmeg Oil with Mace at a shopping complex here about 11.15am on November 11, 2014.

During mitigation, the director, who was unrepresented, told the court that they had received the products from a supplier.

She said they had used the skin products on themselves and no complications had arisen from using them.

The director also said they were remorseful and would be more careful in taking such products in the future.

In reply, the prosecuting officer from the Pharmacy Department told the court that a deterrent sentence would be a lesson to the accused and would-be offenders from committing a similar offence.

The facts of the case stated that officers from the Pharmacy Department had entered a premises at a shopping complex here during an operation. The officers then introduced themselves to a worker in the premises and started to check on the products.

Then they found three types of skin products which were believed to be unregistered, and confiscated the products. The products were sent to the Drugs Control authority and confirmed to be unregistered.

Further investigations revealed that the premises was owned by Merchant Creation Sdn Bhd.
