Man jailed for hurting, threatening woman

KOTA KINABALU: A 24-year-old man was sentenced to 23 months’ jail by the Magistrate’s Court here yesterday for two counts of hurting a 44-year-old woman and threatening her with murder.

Ilie Esie received the sentence after he pleaded guilty before magistrate Cindy Mc Juce Balitus to the charges under the Penal Code.

On the first charge, Ilie was sentenced to seven months’ jail after he admitted to voluntarily hurting the woman in a rented house in Kampung Likas on May 19 at around 10am.

The offence comes under Section 323 of the Penal Code and carries a maximum jail term of one year or a fine of up to RM2,000 or both, upon conviction.

On the second charge, the court meted out 16 months’ jail to Ilie for threatening to murder the woman at the same place and time, which is an offence under Section 506 of the same Code.

The indictment provides for a maximum jail term of seven years or a fine or both, upon conviction.

According to the facts of the case, Ilie was dissatisfied with the victim because he was sleeping in the living room when she asked him to move to his bedroom.

He then uttered harsh words to the victim and punched her in the chest to the extent of bruising, apart from punching her in the forehead three times.

Although Ilie did not use any weapons, he pushed the victim till she fell and hit her forehead on a hard object, resulting in her getting three stitches.

The court ordered Ilie to serve his jail sentences concurrently.

Separately, the Sessions Court sentenced 11 foreigners to between four and five months’ jail with one stroke of the cane for separate charges of entering the State illegally.

Judge Azreena Aziz imposed the custodial sentence on each of the accused persons after they pleaded guilty to their respective charges under Section 6(1) (c) of the Immigration Act 1959/63.

The provision carries a fine of up to RM10,000 or a maximum jail term of five years, upon conviction.

All the accused, aged between 25 and 40 years old, were apprehended by police personnel here and in Keningau.

Upon serving their sentences, the accused are to be referred to the Immigration Department for deportation.
