Dec 9 hearing on couple’s appeal against cheating convictions

KOTA KINABALU: The High Court here yesterday has set December 9 this year to hear the appeal of a couple against their jail sentences over three cheating convictions involving RM280,000, five years ago.

Judicial commissioner, Gabriel Gumis, set the hearing date in th case of Roslena Abdullah @ Roslie Adjun, 47, and Mohd Rosley Asantie, 59, after the prosecution and the appellant’s counsel Ram Singh informed the court that the grounds of judgement from the Sessions Court judge had yet to be received.

The appellants were each sentenced to a total of 56 months’ jail previously after they were found guilty to the cheating charges on December 30, 2014.

On the first count, the appellants were sentenced to 20 months’ jail each for cheating a 53-year-old man on a non-existent ‘Skim Pelaburan Jual Beli Buku’ (Books Investment Scheme) and inducing him to give them RM120,000 in cash.

On the second and the third charges, the couple received another 12 months and 24 months’ imprisonment each for deceiving the same victim of another RM100,000 and RM60,000, respectively for the same purpose.

The court then had ordered for them to serve their jail sentences consecutively.

The offences were committed in a company’s premises at Jalan Tuaran here between January 28 and April 27, 2009.

All the offences were framed under Section 420 of the Penal Code which is punishable with a jail term of up to 10 years and whipping and also liable to a fine, upon conviction.

The judge had extended a stay of the appellants’ execution, pending disposal of their appeals.

Deputy public prosecutor Mohd Khairuddin Idris appeared for the prosecution while counsels Ram and YS Lo represented both appellants.
