Waiter jailed and fined for attack with bottle

KOTA KINABALU: A waiter was jailed for six months and fined RM3,000, in default, two months’ jail by the Magistrate’¦s Court here yesterday for causing hurt to a cook with a bottle.

Mohamad Fazir Norbik, 23, who was brought before magistrate Stephanie Sherron Abbie, pleaded guilty to a charge under Section 324 of the Penal Code.

The charge carries a jail term of up to 10 years or a fine or whipping or any two of such punishments upon conviction.

He caused hurt to the 20-year-old victim outside an entertainment outlet in Penampang at 3.30am on October 4.

Prosecuting officer Inspector Lim Swee Beng told the court that the victim, who came to the entertainment outlet together with his friend for a drink, had lodged a report on the attack on the day of incident.

He said that a group of man had approached them and slapped his friend and hit him (the victim).

On the next day, the police arrested the accused at a pub in Bundusan, Penampang and the accused was positively identified by the victim during an identification parade.

In mitigation, the accused, who was represented by a lawyer from National Legal Aid Foundation (NLAP), said he was unemployed and has a sick father who was not working.

He also said he was a first-time offender, remorseful and promised never to repeat a similar offence again.

In a separate case, a woman claimed trial to four counts of cheating on purchasing houses under the People Housing Project (PPR) in Meruntum, Putatan.

Nurie Azzarina Noor Abdullah, 29, who appeared before the magistrate, was charged under Section 420 of the Penal Code which provides for a jail term of up to 10 years or with a fine and whipping upon conviction.

On the first charge, Nurie Azzarina was alleged to have cheated a woman claiming that she could manage the house purchase and induced the woman to hand over RM1,000 at a restaurant in Putatan at 11am on December 12, 2014.

On the second charge, Nurie Azzarina had allegedly cheated another woman on a similar cause and induced the woman to hand over RM3,000 as a house deposit at Lorong Meruntum at Pantai Lokawi in Papar on March 20, 2014.

Meanwhile, on the third and the fourth charges, Nurie Azzarina was alleged to have cheated another two women for the same purpose which induced both of them to pay RM1,000 each at a restaurant in Penampang at 11.30am on December 3, 2014.

The court fixed October 28 this year for case management and released Nurie Azzarina, who was represented by counsel Arinadzrah, on RM1,000 bail with two local sureties for each charges, pending disposal of the case.

In the meantime, Nurie Azzarina is also facing another four counts of similar offences during her arraignment on August 27.

Nurie Azzarina and Fairieza De Souza, 31, were jointly charged with cheating four persons aged between 28 and 35 by saying that the accused could manage PPR house purchase and induced the victims to hand over to them RM1,400 each through a man.

The offences framed under Section 420 of the Penal Code were allegedly committed at a shopping mall here between June 26 and 27 this year.

Both the accused were released on RM2,000 bail with RM1,000 deposited with two local sureties on each of the charges.
