Labourer jailed 5 years for killing uncle

KUCHING: A skilled labourer was sentenced to five years in jail for killing his uncle during a heated argument last year.

Wilson Peter, 25, from Padawan pleaded guilty before High Court Judge Datuk Yew Jen Kie to a reduced charge of manslaughter.

Wielding a wooden stick, he caused the death of his uncle Davit Taip in a house at Lorong 1, Kampung Subang Padawan here at 7pm on Aug 3, 2014.

Initially he was charged with murder which carries the mandatory death penalty upon conviction but it was subsequently reduced to culpable homicide, not amounting to murder under Section 304 (b) of the Penal Code.

According to his mitigation read by his lawyer Abdul Rahman Hazmi, Wilson’s aunty (Davit’s wife) had forgiven him and he was allowed to visit her and their family members anytime after his release from jail. They live in the same village.

The lawyer believed his client was overwhelmed by guilt and had learnt a lesson – he must live with the stigma of the incident for the rest of his life.

Prior to the incident, the bachelor was doing contracting work like plastering and brick laying among others, earning RM60 to RM70 per day.
