KUCHING: A 45-yest-old man accused of committing incest and oral sex on his 13-year-old niece will have his case heard at the Session Court in Kota Samarahan.
Judge Dayang Ellyn Narisa Abang Ahmad made the transfer order yesterday and ordered the accused to be escorted back to prison where he will be remanded pending the disposal of his case after being denied bail.
The court said the registrar had directed all Kota Samarahan cases be transferred to the court in Kota Samarahan.
The labourer (accused) is alleged to have committed the offence on the girl, who is the daughter to his wife’s sister, at a village in Asajaya around 1am on Nov 2 last year.
When the case was first mentioned, the same judge denied his application to be released on bail fearing that he would still be in contact with her. He is charged under Sections 376(A) and 377(c) of the Penal Code.
