Feb 25-26 trial for Bersih Sabah chief

KOTA KINABALU: Bersih Sabah chairperson Jannie Lasimbang, who claimed trial in October last year to charges under the Peace Assembly Act 2012, will stand trial on February 25–26 this year.

Magistrate Cindy Mc Juce Balitus maintained the trial dates for Jannie, 53, when the case came up for case management.

On the first and second charges, Jannie, who is also a former Suhakam commissioner, is alleged to have organized an assembly at Taman Awam Teluk Likas at Tanjung Lipat here from about 2pm to 9.30pm on Aug 29, 2015 and from 10am to 12pm on Aug 30, without notifying the officer in charge of a police district, Kota Kinabalu (OCPD KK) ACP Chandrasehkaran Muthu, 10 days before the date of the assembly.

She is also alleged to have failed to produce a copy of City Hall’s (DBKK) approval (for the rally venue) and her notification dated Aug 19 to the OCPD KK pertaining to the assembly.

The charges under Section 9 (5) of the Peace Assembly Act 2012 carry a fine of up to RM10,000, upon conviction.

On the first and second alternative charges, Jannie is alleged to have failed to comply with the restrictions and conditions imposed by the OCPD to have the approval of City Hall pertaining to the assembly at the same place and time.

The charges under Section 15 (3) of the same Act 2012 carries a maximum fine of RM10,000, upon conviction.

Jannie was granted bail of RM3,000 with RM1,000 deposited with one local surety, pending disposal of the case.

Deputy public prosecutor Gan Peng Kun prosecuted and Ram was assisted by counsel YS Lo, Timothy Daut, Luke Ressa Balang and Azhier Farhan Arisin.
