Company fined for failing to pay minimum wage

KOTA KINABALU: A company was fined RM2,500, in default, three months’ jail by the Magistrate’s Court here yesterday for failing to pay the RM800 minimum wage to an employee.

Magistrate Stephanie Sherron Abbie imposed the fine on Pemborong Bumihijau Dutyfree Sdn Bhd after its representative pleaded guilty to a charge under Section 43 of the National Wages Consultative Council Act 2011.

The indictment provides for a maximum fine of RM10,000 for each employee upon conviction.

The company had failed to pay the minimum wage of RM800 to the employee for 12 months at Kota Kinabalu International Airport (KKIA) Terminal One here on December 8, 2014.

In mitigation, the company’s representative prayed for a minimum amount of fine.

Prosecuting officer from the Labour Department prosecuted.

Based on the facts of the case, officers from the Labour Department made an investigation into Pemborong Bumihijau Dutyfree Sdn Bhd and found that the company had failed to pay the minimum wage to an employee.

The employee’s service was terminated on January 15, 2015 and one of the company’s directors acknowledged the company’s failure to pay the employee’s wages.
