Cop denies possessing, consuming syabu

KOTA KINABALU: A policeman was yesterday ordered to return to the Magistrate’s Court here on May 18 for the production of his chemist’s report.

Muslim Yahya Bacho, 35, received the date from magistrate Jessica Ombou Kakayun, following his plea of not guilty to both charges of possessing and consuming syabu, which were framed under the Dangerous Drugs Act 1952.

In the first charge, Muslim denied having 0.29 gramme of the drug at the Royal Malaysian Police complex in Kepayan on April 19 around 10.30am.

The alleged offence comes under Section 12(2) of the Act, which carries a fine of up to RM100,000 or a maximum of five years’ jail, or both, upon conviction.

In the second charge, Muslim again denied taking the drug when he was caught at the State Narcotics Crime Investigation Department on a separate occasion.

If found guilty of the offence under Section 15(1) (a) of the Act, he may be punished with a fine not exceeding RM5,000 or imprisonment which may extend to two years.

In setting the date, the magistrate also released Muslim on RM1,000 bail with two local sureties, and ordered him to report to the investigating officer of his case once in two weeks.

Muslim was represented by counsel Aida Jaafar Mad Ariff.

Separately, another man was charged with trafficking 6,212 grammes of syabu by the same court.

Fong Kar Hiuang, who was purported to have trafficked in the drugs for the purpose of selling it to one Wong Sui Yun, pleaded not guilty to the charge under Section 39B of the same Act.

Upon conviction, the indictment is punishable with the mandatory death sentence.

The offence supposedly took place in Inanam on April 12 about 8pm.

No bail was offered to Fong, who was ordered to be detained under Section 259 of the Penal Code, pending the mention of his case on May 23.

Fong was represented by counsel Dato’ Sri K. Rakhbir Singh, while prosecuting officer Inspector Azaman Hamat prosecuted the cases.
