Study on strata titles

KOTA KINABALU: The Sabah government is looking into relevant laws regarding management corporation, issuance of strata and subsidiary titles as well as the complete development plan approval process, said Special Tasks Minister Datuk Teo Chee Kang.

“One of the few enactments that we’re looking at is the subsidiary title enactment. We are also looking into the local government ordinance. I have chaired several meetings since last year, and we have already come to the final stage before we get down to drafting of the proposed amendments of the relevant enactments,” said Teo to reporters at Taman Seputeh in Luyang here yesterday.

“Hopefully by the end of the year we will be able to table the amendment bills at the state assembly. So we believe with such amendments to the law, we can have strata titles, subsidiary titles issued in a speedier manner and we will also be able to resolve problems like either the absence of management corporation or ineffectiveness of the management corporation in dealing with the multilevel, multi-storey residential or commercial buildings with common properties.

“At this stage, we are not sure whether we are amending or we’ll be proposing new enactment. But basically we are looking at it in a very holistic manner; we are looking at the laws regarding management corporation, issuance of strata titles, subsidiary titles and also the whole process on the approval of development plans,” he said.

Teo added that the Land (Subsidiary Title) Enactment 1972 was definitely an area that should be revised in order to solve a lot of the problems faced, especially by the residents, which included the delay in the issuance of the strata titles, subsidiary title problems and problems that might arise with the management corporation.

“We are looking into as to how we can have effective management of common properties, multilevel buildings, residential or commercial. At the same time we are also looking into ways on how we can speed up the issuance of subsidiary titles,” elaborated the minister.
