Man charged with committing incest discharged, not amounting to acquittal

KUCHING: A man charged with committing incest has been discharged, not amounting to acquittal in the Sessions Court after failing to show up.

Judge Afidah Abdul Rahman made the decision after the 51-year-old man from Bau failed to turn up in spite of the warrant of arrest issued against him.

The accused who allegedly committed statutory rape of his biological teenage daughter was issued warrants of arrest four times before.

He allegedly committed the offence on his 16-year-old daughter at their house in Bau three times and one time at a staircase of a shop lot in Batu Kawa MJC.

Statutory rape which comes under Section 376B of the Penal Code provides for an imprisonment term up to 20 years and whipping upon conviction.

In another Sessions Court, a man’s guilty plea to a charge of possessing a dangerous weapon was rejected by the judge.

Presiding Judge Timothy Finlayson Joel adjourned to July 12 for further mention of the case involving Stayfanus Robert, 23, to consider the status of the weapon possessed by him at the time of arrest. Stayfanus will stand trial from Dec 8-9 this year.

Yesterday he told the court that he was drunk and was not aware he was carrying the penknife when detained by police under Satok Bridge around 2.30pm last June 2. He was charged under Section 6(1) of the Corrosive, Explosive Substances and Dangerous Weapons Act 1958 which provides for imprisonment up to two years and whipping.
