Pujut assemblyman’s legal team prepares for next course of action against Hii’s election petition

MIRI: Pujut state assemblyman Dr Ting Tiong Choon today (June 23) sent his legal team to conduct an election petition search in the Miri High Court registrar.

This is early preparation for a reply to be filed later.

Direct BN candidate Datuk Hii King Chiong had filed the petition to declare the results for Pujut constituency null and void on grounds of an election offence being committed.

Hii named Ting as respondent on grounds of false declaration as he alleges that the latter is an Australian citizen, which should disqualify him from standing in the recently held state election.

Ting is being represented by lead counsel Chong Siew Chiang and Alan Ling Sie Kiong.

Chong said the search was being conducted as matter of procedure for the next course of action.

He said that according to Malaysian law, the onus and burden of proof against his client was on the petitioner.

“It must be proof beyond reasonable doubt, and not on the balance of probability,” he said.

Chong hinted that the respondent was likely to apply to the court to strike out the petition.
