Former clerk’s appeal against CBT sentence dismissed

KOTA KINABALU: A former clerk of a private school lost in her appeal against her sentence of five years’ jail on five counts of criminal breach of trust (CBT) at the High Court here yesterday.

Justice Nurchaya Arshad upheld the 20 years’ jail of Helena Baba, 42, after dismissing the latter’s appeal to have her sentence reduced.

On July 16, 2015, the subordinate court found the appellant guilty and sentenced her to four years’ jail on each of the five charges concurrently.

On the first to the fifth counts, the appellant had misused the receipts of a private school at Kingfisher here on Oct 5, Aug 10, May 18, Sept 29 and Oct 28 amounting to RM1,112, RM336, RM1,120, RM2,984.20, RM3,287, respectively.

All the charges were framed under Section 408 of the Penal Code, which carries a maximum jail of 14 years, whipping, or a fine, upon conviction.

The court also dismissed the appellant’s stay of execution which was granted by the lower court, pending an appeal to the Court of Appeal and a cross appeal by the prosecution.
