Trio jailed 20 years for robbing woman

KOTA KINABALU: The Sessions Court yesterday jailed three men for 20 years for robbing a woman of her properties amounting to RM80,000.

Judge Ainul Shahrin Mohamed imposed the sentence on Mohd Fazrul Timothy, 32, Mohd Hisham Albani, 23, and Ali Asar Mohd Salleh, 23, after finding them guilty of the charge under Section 395 of the Penal Code, punishable under Section 397 of the same Code, which provides for a maximum jail of 20 years and whipping, upon conviction.

In her reserved decision, the judge held that the defence had failed to cast doubt on the prosecution’s case.

Apart from that, the court also ordered Mohd Fazrul and Mohd Hisham to be given three strokes of the cane each while Ali Asar to be whipped once.

The three accused persons were convicted of robbing the 31-year-old woman at a house at Taman Salut Perdana in Sepanggar, Manggatal on December 22, 2014.

They had committed the offence with a friend, who is still at large, armed with a samurai sword, a knife and a crowbar during the robbery.

Mohd Hisham and Ali Asar were also ordered to be referred to the Immigration Department after serving their jail terms for further action.

Muhd Fazrul was represented by counsel Datuk Norbert Chin while Mohd Hisham and Ali Asar were defended by counsel Muhamad Amirul Amin.

In a separate case, two men were jailed for eight years and ordered to be whipped once by another Sessions Court for committing a similar offence.

Judge Noor Hafizah Mohd Salim meted out the sentence on Gilben Junior Gallus, 22, and Ericson Andre, 21, after they admitted to robbing a cashier of a 24-hour shop of RM782.40 cash at Jalan Lintas Kepayan here on June 21 using a machete and a cleaver.

Deputy public prosecutor Akmalzatul Mohamed Nawi prosecuted in both the cases.
