Ruling on Sabah Bersih chief Nov 24

KOTA KINABALU: The Magistrate’s Court here yesterday set November 24 this year for its ruling on the case of Sabah Bersih chairperson, who was charged under the Peace Assembly Act 2012.

Magistrate Cindy Mc Juce Balitus amde the adjournment in the case of Jannie Lasimbang, 53, who was charged under Section 9 (5) of the Peace Assembly Act 2012, which is punishable with a fine of up to RM10,000, upon conviction.

On the first charge, Jannie was alleged to have organized an assembly at Taman Awam Teluk Likas at Tanjung Lipat in Likas from about 2 pm to 9.30 pm on August 29 and from 10 am to noon on August 30 without giving notice to the officer in charge of a police district, Kota Kinabalu (OCPD KK), ACP Chandrasehkaran Muthu, 10 days before the date of the assembly.

The second charge stated that she had allegedly failed to produce a copy of City Hall’s (DBKK) approval (on the rally’s venue) in her notification dated August 19 to the OCPD KK pertaining to the assembly.

The charges were framed under Section 9 (5) of the Peace Assembly Act 2012, which is punishable with a fine of up to RM10,000, upon conviction.

Jannie was also slapped with two alternative charges of allegedly failing to comply with the restrictions and on the conditions imposed by the OCPD to have City Hall’s  approval pertaining to the assembly, respectively, both at the same place and time.

These indictments came under Section 15 (3) of the same Act 2012, which also carries a maximum fine of RM10,000, upon conviction.

Jannie, represented by counsel Ram Singh, is currently released on RM3,000 bail with RM1,000 deposited in one local surety, pending disposal of the case.
