China woman loses appeal against death sentence

KOTA KINABALU: A woman from China who was convicted for drug trafficking had her death sentence affirmed by the Court of Appeal here yesterday.

The three-panel judge chaired by Dato’ Tengku Maimun Tuan Mat, Datuk Dr Prasad Sandosham Abraham and Dato’ Zabariah Mohd Yusof unanimously made the decision on Yu Jing, 25, after the latter’s appeal against her conviction and sentence was dismissed.

The judges agreed that there was no error in the High Court’s decision and found that there were no reasons to disturb the High Court’s decision.

Yu Jing was sentenced to death by hanging by the High Court here on October 15, 2015 after she was found guilty under Section 39B (1) (a) of the Dangerous Drugs Act 1952, which carries the mandatory death sentence, on conviction.

She had trafficked in 3,492 grams of syabu at the office of the Customs Department, passengers’ check-point branch at the Kota Kinabalu International Airport (KKIA), Terminal two here at 10.50pm on June 22, 2014.

Earlier, counsel Ram Singh, who represented the accused, submitted that Yu Jing had no knowledge about the said drugs and that she was an innocent carrier.

Deputy public prosecutor Dato Ahmad Kamal MD Shahid rebutted that the case was not of the innocent carrier and the appellant should have checked everything in her luggage.

He said that the appellant knew that the drugs were inside the luggage, which was put in a concealed compartment.
