Feb 21 trial for causing hurt

KOTA KINABALU: The Magistrate’s Court here yesterday fixed February 21 this year for the trial of a man who was accused of voluntarily causing hurt to another man.

Magistrate Cindy Mc Juce Balitus made the order on Nicholas Benedict Barry when the case came up for case management yesterday.

The accused was charged under Section 323 of the Penal Code which provides for an imprisonment up to two years, or a fine up to RM2,000, or both, upon conviction.

The accused allegedly hurt Rosli Selamat on November 11 last year at around 6am at Taman Luyang.

Counsel Azhier Farhan Arisin, who acted for the accused, had also applied for another case management date for monitoring purposes.

The court fixed February 2 for further case management and ordered the prosecution to serve its documents on the accused.

Meanwhile in the same court, a youth’s trial for stealing a motorcycle was fixed on February 20 this year.

Cindy made the order on Azeroy Yong when the case came up for case management yesterday.

The unrepresented accused was charged under Section 379A of the Penal Code which carries a maximum jail of seven years and a fine, if convicted.

Azeroy was accused of stealing the Honda EX5 belonging to one Awang on November 24 last year between 2.30am and 3am at a supermarket in Putatan.

The accused had initially pleaded guilty but he then changed his plea from guilty to not guilty.

The court also ordered the prosecution to serve its documents on the accused who was also intructed to appoint a counsel.

Prosecuting officer Inspector P. Nathan prosecuted in both cases.
