Drug accused cried when cops examined substances – DPP

KOTA KINABALU: The trial of a 32-year-old man for trafficking in 664.9 grams of syabu began at the High Court here yesterday.

Andy Lim Shau Seng, who was brought before justice Datuk Nurchaya Hj Arshad, faces a charge under Section 39B (1)(a) of the Dangerous Drugs Act 1952, which carries the mandatory death sentence, upon conviction.

He was alleged to have committed the offence in front of an eatery at Jalan Gaya here at 4.30pm on August 29, 2016.

In opening address, deputy public prosecutor Gan Peng Kun told the court that the prosecution would lead evidence that the police narcotics raiding team was in front of an eatery in Jalan Gaya at 4.15pm on August 29, 2016.

He said the accused was seen coming out of a taxi and carrying a paper bag.

Then while the accused was sitting on a low wall for 15 minutes, the police apprehended him after asking about the contents of the paper bag.

The accused and the paper bag were brought to the Sabah police headquarters, where the bag was inspected and three boxes were taken out of it.

The first box was orange in colour and found to be containing two plastic packets with crystalline substance.

The second and third boxes were yellow in colour and found to be containing plastic packets with a similar substance.

All the crystalline substances were believed to be dangerous drugs.

Gan also pointed out that the accused was crying throughout the examination by the police.

Production of further evidence will be led by the prosecution to show that the accused had provided information that his friend was waiting at Imago Shopping Mall in a silver car.

Gan added that the prosecution would also adduce evidence that all the boxes were sent to the Chemistry Department and the analysis of the crystalline substances was found to have contained 664.9 grams of methamphetamine.

He also said that in the trial of the case, the prosecution would show that the accused was found to have in his custody the paper bag containing the dangerous drugs.

Therefore, the accused would be deemed to have been in possession and knew the nature of such drugs.

Moreover, the accused is also presumed to be trafficking in the dangerous drugs as the weight of the drugs is 664.9 grams.

The prosecution will further show that the totality of the evidence will point to the irresistible conclusion that the accused did in his own behalf trafficked in the said drugs.
