Homestay operator fined RM10,000 for recording naked individuals

IPOH: A homestay operator was fined RM10,000 in default 18 months imprisonment by the Magistrate’s Court here today for illicitly recording eight members of a family while they were bathing naked in the bathroom on separate occasions via a closed-circuit television (CCTV) camera, three years ago.

Lim Lai Heng, 45, pleaded guilty to eight charges of outraging the modesty of five females and three males aged between 17 and 53 years at Taman Canning on July 27, 2014, between 2.30 pm and 11.30 pm.

The charges are framed under Section 509 of the Penal Code which carries a jail term of up to five years or a fine or both on conviction.

Deputy public prosecutor Nurul Azriah Zaid appeared for the prosecution while Lim was represented by counsel Dexter Mah.

Nurul Azriah said when met outside the court that the businessman was initially charged with the offences on Oct 1, 2014 at the Magistrate’s Court in Ipoh and given a discharge and acquittal on Nov 25, 2016.

“The prosecution appealed to Ipoh High Court which on July 28, 2017 set aside the decision of the magistrate’s court and ordered Lim to enter his defence,” she said. – Bernama
