Three men, woman jailed 30 months for causing death

KOTA KINABALU: The Sessions Court here yesterday sentenced three men and a woman to 30 months’ jail for causing the death of a 22-year-old man.

Judge Indra Hj Ayub imposed the jail sentence on Abraham Rahmon, 32, Nasir Omar, 33, Tannalin Montoh, 52 and Husna Mangkabong, 39, who were jointly charged under Section 304 (a) of the Penal Code, read together with Section 34 of the same Code, which provides for a jail term of up to 30 years and a fine, upon conviction.

They were found guilty of committing culpable homicide not amounting to the murder of Ali Talani near an unnumbered house at Kampung Guruh-Guruh in Sipitang between March 23 at 11am and March 24 at 2am, last year.

In mitigation, all of the accused persons, who were not represented, prayed for a lenient sentence on the grounds that they were remorseful and promised to the court that they would not repeat a similar offence.

Abraham also told the court that he committed the offence because the deceased had raped his wife.

In reply, Deputy Public Prosecutor Mohd Khairuddin Idris urged the court to impose a deterrent sentence on the accused persons as their offence had caused a life to be lost.

He said the accused persons should not have taken such matter into their own hands.

The court also ordered the accused persons to start their jail sentence from their date of arrest.

The prosecution had produced five witnesses to testify against the accused persons while five witnesses were called at the defence stage throughout the trial.
