Tycoon, ex-cabinet ministers are party in PKA lawsuit

PUTRAJAYA: A tycoon and two former cabinet ministers are among 23 individuals who will be a party in Port Klang Authority (PKA)’s lawsuit against its former general manager Datin Paduka Phang Oi Choo or OC Phang.

This followed the Federal Court’s decision today to dismiss the leave to appeal applications by G Gnanalingam, who is Wesport Malaysia Sdn Bhd executive chairman, ex-ministers Tan Sri Dr Ting Chew Peh and Tan Sri Chor Chee Heung, and 20 others.

All of them are former PKA board members.

They were appealing against the appellate court’s decision on Feb 17 this year to include them as third party defendants in the suit.

Chief Judge of Malaya Tan Sri Ahmad Maarop chairing the panel which also consisted of Federal Court judges Tan Sri Hasan Lah and Tan Sri Abu Samah Nordin, said leave could not be granted to the 23 people as they did not satisfy the requirements under Section 96(a) of the Courts of Judicature Act 1964.He said there were triable issues requiring the case to proceed, and ordered them to pay RM10,000 costs to Phang.

PKA had sued Phang for breach of duty as its former general manager in relation to the Port Klang Free Zone (PKFZ) controversy.

Phang in turn filed third party notices to include the 23 individuals who were PKA board members at the material time in the suit.

Her application was struck out in 2015 by the High Court.

But she resorted to the Court of Appeal, which ruled in her favour. — Bernama
