Shafie’s application for remand review dismissed, remand extended by 4 days

KOTA KINABALU: The High Court here today dismissed a review filed by Parti Warisan Sabah president Datuk Shafie Apdal regarding his remand issued on Friday.

Judicial Commissioner Ismail Brahim ruled that he did not agree with counsel Hamid Ismail, who was one of the lawyers representing Shafie, and affirmed the order made by Magistrate Cindy Mc Juce Balitus.

Hamid submitted, among others, that Malaysia Anti-Corruption Commission (MACC) has its own provision relating to arrest and investigation, and that provision is different from Section 117 of the Criminal Procedure Code, which is used by the MACC to remand his client.

Hamid, when met outside the court, said that they will file a leave to appeal at the Court of Appeal against the High Court’s decision within this week.

Shafie’s remand has also been extended by four days, effective tomorrow.

Deputy Public Prosecutor Rustam Sanip said they applied for an extension of seven days but was only granted four days by Magistrate Cindy Mc Juce Balitus.

One of his lawyers Martin Tommy Durasim when met after the proceeding expressed surprised at the extension of MACC’s remand.

“I am surprised that the remand has been extended for four days. We didn’t expect that he will get four days extension because he has cooperated fully with MACC. He has completed taking all the statements, did all the was necessary, specific documents that MACC asked from him are ready to be handed over to them.

“And being a Member of Parliament, he has to attend parliament especially so for the tabling of the budget (on Oct 27). These are the things we have informed the court and I think the court has considered all this. He has fully cooperated despite him not feeling well the other day, he actually decided to come to court,” Martin said.

Meanwhile, Shafie’s younger brother, Lahad Datu assemblyman Datuk Yusof Apdal was released today with no condition after being under MACC’s remand for six days.
