Youth accused of sexually assaulting 5-year-old girl to stand trial from Nov 21-24, bail denied

KUCHING: The Sessions Court here yesterday fixed Nov 21-24 for the trial of a youth accused of sexually assaulting a five-year-old girl.

Judge Afidah Abdul Rahman made the decision on Mohamad Asrul Ahmad, 21, who pleaded not guilty, and instructed the prosecutor to produce all the witnesses.

She also denied bail for the accused and ordered him to be further remanded in prison.

For the first charge, Mohamad Asrul was alleged to have touched the private part of the girl at about 12.30pm on July 26 this year at Kampung Tambirat, Asajaya.

For the second charge, he allegedly forced the girl, who is his neighbour, to touch his private part at the same time, date and venue.

He is charged under Section 14(a) and 14(b) of the Sexual Offences Against Children Act 2017, punishable under Section 14 of the same act, which provides for imprisonment not exceeding 20 years and liable to whipping.

In another Sessions Court room, a teacher accused of raping his underage student had his case adjourned to Nov 11 for further mention.

The trial of Muhaini Bojeng, 52, was fixed for Nov 27-29 as the chemist report was not ready.

Muhaini, who was represented by lawyer Francis Teron Kadap, had claimed trial to counts of statutory rape against a 14-year-old Form 2 student.

He allegedly committed the offence in a car at a parking lot behind a supermarket in Siburan some time between 12.30pm and 2pm in August this year.

He allegedly repeated the offence on Sept 14 this year at about 11.40am at the same secluded area.  It was said the accused picked up the girl from school before committing the offence.

The case is being tried under Section 376 of the Penal Code which provides for imprisonment up to 30 years and whipping upon conviction.
