School clerk denies raping his three years 11 months daughter

KOTA KINABALU: A school clerk claimed trial at the Sessions Court here yesterday to raping his three-year-old and 11 months daughter.

The 47-year-old man, who was brought before  judge Ainul Shahrin Mohamed, faces a charge framed under Section 376(3) of the Penal Code.

The indictment provides for a jail term of between eight and 30 years, and at least 10 strokes of the cane, upon conviction.

He was alleged to have committed incest against the toddler at a house in Kota Belud in daylight on Oct 31 this year.

In applying for bail, the unrepresented accused told the court that he needed to support his mother and wanted to engage a lawyer.

Meanwhile, deputy public prosecutor Dinesh Raja objected to the bail application due to the seriousness and nature of the offence.

Dinesh also informed the court that 14 witnesses would be called to testify against the accused.

The court fixed June 4 – 6 next year for trial and released the father of six on RM20,000 bail with a local surety, pending disposal of the case.

He was also ordered to report to the Kota Belud police station once a month and was prohibited from leaving the residential address and if he wished to do so he must inform the Kota Belud Police chief.

The accused was also told not to have any contact with any of the prosecution witnesses especially the alleged victim and her immediate family.

The court said if any of the above conditions was breached, the accused would be arrested by any police officer and brought to court for immediate revocation of the bail under which he was remanded pending disposal of the case.
