Man gets 10 month’s jail, fine for stealing from employer

MIRI: The Magistrate’s Court in Batu Niah on Tuesday sentenced a shopkeeper to ten months’ imprisonment and a fine of RM6,000 in default three months’ jail for stealing goods belonging to his employer.

Magistrate Zuraini Ali Musa imposed the sentence after Gilbert Gumbang pleaded guilty to the offence under Section 381 of the Penal Code, which provides for a jail term of up to seven

years and/or a fine upon conviction.

According to the brief facts of the case, Gilbert, 24, from Senadin Village, was found to have stolen several items including two handphones, 11 cables and 17 cellular phones belonging to his employer.

He committed the offence at 2pm, November 17 last year at a premises along Jalan Persiaran Kabor here.

In the same court, Zuraini sentenced two men to seven months in jail for having a stolen vehicle at 4.30am on January 21 this year at KM11 Bintulu-Miri road.

She imposed the sentence after taking into consideration several aspects including guilty plea and mitigation, facts of the case, seriousness of the case and public interest.

Jeffery Adom, 36, and John Belulok, 30, both from Uma Sambop, Long Semutut, Belaga, were charged under Section 411 of the Penal Code read together with Section 34 of the same Code which provides for imprisonment term of not less than six months and not more than five years and a fine upon conviction.

According to the brief facts of the case, both accused were found guilty of receiving or storing stolen property, a vehicle belonging to Yong Poh Yew bearing registration number QLB39xx, at 4.30am, January 21 at KM11 Bintulu-Miri road.

Prosecution for the two cases was conducted by ASP Mary Ong, while all the accused were not represented.
