April 23 verdict on Sabah’s 13 new seats issue

KOTA KINABALU: The High Court here today maintained April 23 to deliver its decisions on two originating summonses filed separately by two political parties, including former Sabah Chief Minister and political leaders, seeking a declaration that the Prime Minister shall lay as soon as possible an Election Commission (EC) report regarding the additional 13 State Assembly seats.

The oral reply on submissions filed by the applicants, was held in chambers before Justice Azhahari Kamal Ramli which lasted about two hours.

The first summons were filed by opposition Gabungan Sabah leaders led the ex-Sabah Chief Minister Datuk Yong Teck Lee, 60, with six others namely Dato Shuaib Dato Mutalib, 61, Edward Dagul, 52, Japiril Suhaimin, 55, Linggu@ Edward Bukut, 60, Jovilis Majami, 39 and Anesthicia Usun, 37, on April 4, naming the Prime Minister of Malaysia and the EC of Malaysia as first and second defendants, respectively.

Then April 5, Parti Cinta Sabah (PCS) members namely its president Datuk Seri Panglima Wilfred M Bumburing, 67, Kalakau@ Kalakan Untol, 64, Petrus Francis Guriting, 63, Robert Sopining, 42 and Shalmon Sanangan had filed their summons naming the Chief Minister of Sabah, state government of Sabah, the Legislative Assembly of Sabah and the Election Commission of Malaysia as first, second, third and fourth defendants, respectively.

Both parties seeking a declaration that the Prime Minister shall present or table the report to parliament as soon as possible after the the report given to him.
