Bill Kayong case: Court sets July 3 to hear oral submissions

MIRI: The High Court here today fixed July 3 to hear oral submissions in the trial for the murder of land activist and Parti Keadilan Rakyat (PKR), Miri branch secretary Bill Kayong.

Judge Ravinthran N Paramaguru set the date to hear oral submissions from both the prosecution and defence, as the prosecution had applied to conclude their case today against Mohamad Fitri Pauzi, the first accused charged in the murder case.

Deputy public prosecutor (DPP) Nur Nisla Latiif decided to conclude her case after calling 28 witnesses, including recalling today the 18th prosecution witness Farah Al-Din Nordin, a Gun Shot Residue (GSR) expert from the headquarters of the Chemistry Department in Petaling Jaya.

Farah, 31 was recalled for cross examination by Ranbir Singh, who is the counsel for Fitri.

When examined by Ranbir, Farah, 31 agreed with the statement that the entire analysis process was conducted by Mohd Firdaus Ramli – a Gun Powder Residue (GPR) expert from the Chemistry Department in Kuching. She herself only interpreted the report.

Meanwhile, when asked by Nur Nisla on why she agreed with the statement, Farah explained that Mohd Firdaus handled the analysis instrument during the analysis process.

She said during that time, it was Mohd Firdaus’ turn to operate the instrument, although at that time she herself was in the laboratory. She interpreted the result of the analysis because it was her case.

Mohamad Fitri Pauzi, 30, from Jalan Dawai 1 Pujut 4D here – the sole defence witnessed, was charged under Section 302 of the Penal Code which provided for mandatory death sentence upon conviction.

The offence was allegedly committed by the accused at 8.20am, June 21, 2016 at the traffic light intersection near E-Mart Supermarket in Kuala Baram Bypass.

Three other Mirians charged for abetting with Fitri, Lie Chang Loon,; Datuk Stephen Lee Chee Kiang and Chin Wui Ching were released and acquitted of all charges.

Also present at the hearing today were defence counsel Orlando Chua and Arthur Lee, while Majen Panyog was watching brief for the family of the victim.as an attorney on behalf of Bill’s family.
