KUCHING: A magistrate’s court here yesterday fined a septuagenarian RM1,000 in default four weeks’ jail after he pleaded guilty to an amended road accident charge.
Tay Joo Thian, 71, will also have his driving licence endorsed.
He committed the offence in 2012 when he lost control of the four-wheel drive vehicle he was driving and crashed into a car going in the opposite direction at Jalan Tun Zaidi Adruce, resulting in the death of the other driver.
Tay contravened Section Rule LN166/56, which is punishable under Section 119(2) of the Road Transport Act 1987 (Act 333/87) read together with Section 128 (1) of the same Act, which provides for a maximum RM2,000 fine and up to six months in prison.
Counsel Roger Chin represented Tay, while Insp Ardy Azwin prosecuted.
In the same courtroom, a lorry owner was fined RM1,500 in default seven days in prison after he pleaded guilty to a traffic offence of overloading cargo in his lorry.
Wong Ngie Wong @ Ngie Seng, 57, committed the offence on April 2, 2018 at Jalan Bako, when his lorry was overloaded with cargo weighing 31,400kg – 10,400kg more than the allowable load of 21,000kg.
The offence comes under Section 19(1) (b) (vi) of the Commercial Licensing Board Act 1987.
Both cases were heard before Magistrate Mohd Syukri Mokhtar.
