MIRI: A senior citizen was charged in a magistrate’s court here yesterday with raping and sexually harrassing a neighour’s daughter.
Gili Enpaling,72, was charged under Section 376 (2) (e) of the Penal Code which carries a jail term between 10 and 30 years and liable to whipping upon conviction.
According to the charge sheet, the accused who operates a canteen at his house allegedly raped the girl aged 11 years and 11 months (at the time of the incident) between 7am on Oct 10, 2017 and 8pm on Dec 22, 2017 at his house here.
Apart from that, the accused faced another charge under Section 14(a) of the Sexual Offences Against Children Act 2017 for committing physical sexual harassment on the same girl, with the intention to have sex with her.
He allegedly committed the offence at the same time and place.
If found guilty for the offence, the accused faced a jail term of up to 20 years and whipping if convicted.
Earlier, prosecuting officer Insp Mohd Khairi Mohd Noor applied for a new date for further mention of the case in the Sessions Court.
Lower Court Registrar Brian Bryan Mason allowed the application and set Sept 18 for the case to be further mentioned at the said court.
Meanwhile, the accused was ordered to be freed on RM3,000 bail with two local sureties while awaiting the hearing date.
