Musa’s suit: Rival supporters warned to behave at courthouse tomorrow

KOTA KINABALU: Supporters from Parti Warisan Sabah and Barisan Nasional are reminded to behave themselves during Thursday’s civil suit where Sungai Sibuga assemblyman Tan Sri Musa Aman is challenging the legitimacy of Parti Warisan Sabah president Datuk Seri Mohd Shafie Apdal’s appointment as Sabah Chief Minister.

Sabah Commissioner of Police Datuk Omar Mammah gave the warning to all supporters and parties to behave and abide by the law to prevent untoward incident from happening.
“We are aware that supporters of both parties will gather at the Kota Kinabalu Court Complex on Thursday.

“We have also been informed that they will be gatherings at the state administration building either to show their support or to protest the result.

“So to prevent any untoward incident from happening, I urge and remind all party supporters to behave themselves, refrain from any provocation or causing any disturbance as we will not hesitate to take legal action,” he said.

Omar said this during his working visit to the Kota Kinabalu Police Contingent (IPD KK) at the Karamunsing Police Headquarters on Tuesday.

Also present at the event were city police chief ACP Habibi Majinji, Superintendent George Abdul Rakman and other senior police officers.

Police have also decided to limit the number of people allowed to enter the court complex due to the size of the complex and to prevent disturbance during other court proceedings.

“There will be other court proceedings during that day so to prevent any disturbance or distraction, we have to limit the number of people being allowed to enter the court complex,” he said.

Police will be monitoring both the court complex and the state administration building while no major roads will be closed.

The High Court had rescheduled for October 25 to hear submissions from both parties on who will be the legitimate Chief Minister of Sabah.

On August 24, Kuching-based High Court Justice, Datuk Yew Jen Kie, had fixed October 26 for the decision of Musa’s originating summons (OS) after dismissing Mohd Shafie’s application to strike out the OS, and ruled that Musa has raised question of law in his OS.

Musa, who was the former Sabah Barisan Nasional chairman, is seeking a court declaration that he is the legitimate Chief Minister as appointed by Yang Di-Pertua Negeri Tun Juhar Mahiruddin on May 10.

Musa has named Juhar and Parti Warisan Sabah president Datuk Seri Mohd Shafie Apdal, who was appointed Chief Minister on May 12, as the first and second defendants in his suit.

Both Musa’s Sabah Barisan Nasional and Shafie’s Warisan and its partners PKR and DAP, won 29 seats.

Musa was sworn in as the chief minister on May 10 after Sabah STAR which won two seats in the election, decided to join Sabah BN.

But within 48 hours, Musa lost his majority following several defections from BN into Warisan Sabah, prompting Shafie to be sworn in as the state chief minister on May 12.
