KOTA KINABALU: Forty-six factories were inspected through the Department of Labour Ops Patuh (Compliance Operation) which was held simultaneously throughout Sabah on February 18 and 19.

Fourteen compliance notices were issued against employers for violation of the Labour Ordinance (Sabah Chapter 67) and the Minimum Wage Council Act during the operation, which was conducted by the enforcement division of the Sabah Labour Department.

The employers were also directed to take appropriate corrective action over the non-compliance. If they fail to do so, legal action, including prosecution, may be taken against the employer found violating the relevant provisions of the applicable laws.

Among the non-compliances detected were, the failure of the employer to keep their employees’ personal register; the failure of the employer to keep a register of the terms and conditions of employment; the failure of the employer to keep record of the payroll and allowances; the failure to pay annual leave; the failure of the employer to pay salary on specified period to the employee, the failure of the employer to keep maternity leave register, of giving sick leave, of salary deductions other than allowable deductions, and failing to pay minimum wage.

Meanwhile, simultaneous operations will be conducted throughout Sabah every month besides regular enforcement operations to ensure compliance with the labour laws by employers, and to preserve the rights of workers under the law in those sectors that employ many workers.
