Security guard, welder get 15 years’ jail for causing death

KUANTAN: A security guard and a welder were jailed 15 years each by the High Court here yesterday for causing the death of a man two years ago.

Mazuki Zakaria, 28, a part-time security guard at an entertainment outlet, and Asswadie Shah Khairudin, 23, pleaded guilty to an amended charge of causing bodily injuries which could kill Amran Samad with another still at large at a car park near Sakura Bar, Jalan Wong Ah Jang, here, at between 11pm and midnight on Sept 1, 2007.

The charge of culpable homicide not amounting to murder carries a maximum 20 years jail and liability of a fine. They were originally charged with murder.

Judicial Commissioner Datuk Mariana Yahya ordered the jail terms to start for the date of their arrest on Sept 25 and 27, 2007, respectively.

The court was told that the two, together with another still at large, had beaten, kicked, slapped and stomped on Amran’s chest and head.

Mariana, in passing sentence, said they should not have taken the law into their own hands although they were provoked by Amran.

They were lucky to have escaped the hangman’s noose after the prosecution amended the charge and the court hoped that they would learn a lesson from this, she said.

“You can still go back to your families after serving your sentences but the deceased’s family has lost him forever,” she added.

Earlier, their counsel, Rizal Hashim, pleaded for leniency, saying that the incident was not planned and no weapon was used.

However, deputy public prosecutor Ahmad Fadhli Mahmud asked for a deterrent sentence because a life had been lost. — Bernama
