SHAH ALAM: The Shah Alam High Court yesterday sentenced a hair dresser from Hong Kong to five years jail, for possessing 1,067 grammes of ketamine, five years ago.

Judicial commissioner Datuk Asmabi Mohamad found Tsui Chi Wa Joey, 46, guilty of an alternative charge under Section 12(2) of the Dangerous Drugs Act 1952 for possession of ketamine which was punishable under Section 12(3) of the same Act.
Under Section 12(3) of the Act, anyone found guilty can be sentenced to a maximum of five years jail or RM100,000 fine or both.
Tsui was earlier charged under Section 39 B(1)(a) of the Dangerous Drugs Act 1952 which carries the mandatory death sentence upon conviction under Section 39B (2) of the same Act, for trafficking ketamine at the Satellite Building of the Kuala Lumpur International Airport (KLIA), Sepang at 7.50pm on Feb 18, 2005.
Asmabi said Tsui was sentenced to five years jail after taking into consideration that the accused who did not have any previous records, had pleaded guilty to an alternative charge thus saving the court’s time, and also taking into consideration that his wife had left him when he was detained in Malaysia.
Leong told reporters outside the court that technically Tsui would be a free man because the sentence was effective from the date of his arrest and also his good behaviour in prison.
However, Tsui’s freedom may take some time since time would be needed in processing his passport that had expired.
Tsui was also represented by R Chandra while the prosecution was led by deputy public prosecutor Mohd Suhairy Zakaria. — Bernama
